In Family Law, We Have Done It All

Seattle Prenuptial Agreement Attorneys

Preparation Today Can Save Money in the Future

Although many people consider prenuptial agreements necessary only for people with a high net worth, they are also useful tools for people with more modest assets, or those who believe they will come in to money. In fact, they are beneficial for anyone who wants to protect their assets in the event of divorce or the death of a spouse, or set aside assets for children in blended families.

Negotiating a prenuptial agreement is a sensitive issue. However, it is also a practical matter that may save significant expense and lengthy disputes if the marriage ends. Our experience with all areas of family law, including divorce and high-asset divorce, means that we are skilled at drafting prenuptial agreements, postnuptial agreements and cohabitation agreements, regardless of the complexity of the assets. Please call our office at 206-905-4290 or toll-free 866-970-4558 for an appointment with our Seattle prenuptial agreement lawyers.

A Prenuptial Agreement Has Many Purposes

People usually choose to sign prenuptial agreements to protect assets and avoid the possibility of expensive divorce litigation in the future. A prenuptial agreement establishes what each party’s property rights will be if the marriage ends in divorce or if one spouse dies before the other. It is a legal contract detailing the assets and debts each person has prior to the marriage. There must be full and fair disclosure from each party when drafting the agreement — if all assets and debts are not disclosed, the agreement will not hold up in court.

You can use prenuptial agreements to:

  • Maintain assets you brought to the marriage
  • Keep individual debts separate
  • Protect assets for children in blended families
  • Specify maintenance (alimony) in the event of divorce
  • Specify property rights in the event of divorce
  • Protect a family business

If you have significant assets or sophisticated financial holdings, you need an attorney with considerable experience to draft a prenuptial agreement. We can assist you with finding hidden assets, valuing assets and negotiating the agreement.

Because this is a fluid field in the law, you must not assume anything except what your lawyer advises you. We can assist you. Please note that prenuptial agreements are not always the preferred solution.

For unmarried couples, whether same-sex or heterosexual, who live together in arrangements, known as meretricious relationships or committed intimate relationships, a cohabitation agreement can protect property rights.

Postnuptial agreements are also similar to prenuptial agreements, but are created after a couple is married. You can create a postnuptial agreement after you are married to protect new assets you acquire during the marriage.
